After separation and/or divorce, nothing stays the same. Circumstances change, parents and children change, and incomes and expenses change. Family court orders and separation and/or divorce settlements sometimes need to change to reflect changes in the family.
To obtain a custody or support modification, typically you must show that there has been a substantial change of circumstances that makes the original custody or support order unfair or unworkable.

Changes Justifying a Change of Custody and Visitation
During a separation and/or divorce, parents work out a custody and parenting plan or the family court decides the custody and visitation arrangements for the parents. Custody and visitation plans that worked at the time of the separation and/or divorce might not work years later.
An older child may want to live with the non-custodial parent. A parent may be unable to care for the child because of illness or other life circumstances. The parent without custody may think that the custodial parent is unfit to care for the children or is neglecting them. In deciding whether to change custody or visitation, the family court judge will try to order what is in the child's best interest.
Changes Justifying a Change of Child Support or Spousal Support
A child support or alimony order that was fair at the time of the separation and/or divorce may need to be changes later. A spouse who loses his or her job may be unable to pay child or spousal support. Other increases or decreases in expenses or income may require a financial support modification.
